Mobile Home Community Rules

The Vauxhall Mobile Home Community strives to be an enjoyable, peaceful, and comfortable place to live. A community where families flourish and individuals plant roots. We have drafted these rules with these goals in mind and we seek your feedback to alter or improve these rules to accommodate and balance the needs of all current and potential future residents of our community.

Except as otherwise noted these rules will take effect on February 1, 2025 and replace all previous Mobile Home Community Rules whether written or verbal.

1.     Good Behaviour

a.       Community Residents shall conduct themselves in a respectful manner that is mindful of other residents and their mutual rights to peaceful enjoyment of the Community.

b.       Community Residents shall be responsible for the behaviour of their guests and children.

c.       Community Residents shall be responsible for any damage caused to private or common property.

2.     General Appearance

a.       All Mobile Homes and lots must be maintained in good overall condition.

    i.      All Mobile Homes, structures, and other property shall be kept free of:

1.       broken windows

2.       visible rust or oxidation

3.       bleached or peeling paint,

4.       derelict vehicles, or

5.       other visible damage.

ii.      Lots may not be used for long-term storage and shall be kept free of:

1.       garbage

2.       construction debris

3.       derelict vehicles

4.       accumulated household waste

5.       accumulation of personal effects, or

6.       other unsightly items.

iii.      All Mobile Homes and other fixed property excluding fences (including outbuildings, porches, additions, storage sheds, animal shelters, and other fixed private property) must be clad in a fire-resistant water-tight building material such as vinyl siding, aluminum siding, asphalt shingles, or other similar building materials. Alternative building materials may be approved in writing by Community Management on a temporary basis.

iv.      All Mobile Homes shall be identifiable from an internal road by their designated lot number, which shall be a minimum of four inches in height.

b.       Community Residents are welcome to conduct work or repairs on their Mobile Homes or other existing fixed property without prior approval from Community Management, so long as external renovations are completed within 90 days of commencement. Extensions may be granted by Community Management in extenuating circumstances.

c.       Should a Mobile Home or other fixed property become damaged, Community Residents shall make full repairs within 30 days of the damage occurring or when requested by Community Management, whichever occurs earlier. Extensions may be granted by Community Management in extenuating circumstances.

d.       Structures including outbuildings, porches, additions, fences, storage sheds, animal shelters, or other fixed private property shall not be erected without written permission from Community Management. Construction on structures that has been partially completed on the enactment of these rules must receive written permission from Community Management in order for construction to continue.

e.       Community Residents shall maintain their lots on a regular basis, including cutting grass, trimming shrubs, removing snow, and shall ensure their lot is neat, clean, and free of litter or hazards.

f.        Community Residents shall ensure that Mobile Homes are leveled, blocked, and skirted within 90 days of being moved onto a lot.

3.     Maintenance

a.       Snow removal from individual lots or private parking areas is the responsibility of each respective Community Resident.

b.       Snow removal from main community gravel roads will be conducted on an as-needed and as-available basis during the winter months.

c.       Community Residents are welcome to conduct minor repairs to their vehicles on their lots, however work spanning multiple days on vehicles cannot be conducted within the Community without prior approval from Community Management.

d.       Community Residents must ensure that hazardous wastes such as oils and antifreeze are not spilled onto the ground and are safely and completely removed from the property. Community Management will provide containers and dispose of spent oil upon request.

e.       Community Residents shall not dig underground for any reason without prior approval from Community Management. This includes digging for fence posts, flower beds, or vegetable gardens.

4.     Approval of Mobile Home Sales and Community Residents

a.       Anyone who wishes to move into the community, by invitation, through the rental of an existing mobile home, by purchasing an existing mobile home, or by moving a mobile home into the community must first be approved in writing by Community Management.

b.       Selling, renting, subletting, or assignment of tenancy of Mobile Homes must first be approved in writing by Community Management

5.     Rent, Fines, and Fees

a.       Rent for each lot shall be $410 per month and is due on the last day of the preceding month.

b.       A late fee of $45 will apply for any rent not received by the due date, which shall form part of rent due, and shall be payable on the first day of default.

c.       A dishonoured payment fee of $75 shall apply for any NSF or dishonoured payments.

d.       Community Management may levy notices or fines for non-compliance of these rules. Fines for minor violations shall range from $5 to $45 per occurrence or per day of non-compliance and fines for major violations shall range from $50 to $150 per occurrence or per day of non-compliance.

e.       Late rent and any fines or fees carry an annualized interest rate of 19.90 percent compounded monthly (for an APR of 21.82 percent) from the due date.

f.        Community Management may, as needed and in its sole discretion, act in place of and due to the failure of a Community Resident. In such situations, costs, including administrative fees, shall form part of rent due and shall be payable by the Community Resident when notified of the charges.

g.       All payments by a Community Resident shall be firstly applied to fees, fines, and other charges, and secondly to rent due.

6.     Pets

a.       Community Residents are welcome to keep up to two pets per lot.

b.       Pets must be kept indoors or secured in a fully enclosed pen and attached to immovable fixed property with a chain.

c.       Community Residents may not keep outdoor pets and may not feed other animals.

d.       Community Residents must ensure that excrement from their pets is cleaned immediately and disposed of in their garbage.

7.     Other Matters

a.       Community Residents are responsible for insuring their property against loss, including losses incurred by their own actions and losses caused by others

b.       Community Residents are responsible for protecting utility connections and lines within their lots and are liable for damage done to the same, including damage caused by negligence or freezing.

c.       Soliciting, peddling, or other commercial activities are not permitted within the Community.

d.       Community Residents use land equidistant between their Mobile Home and the Mobile Home on the lot immediately adjacent their lot. Should the adjacent lot be vacant, the equidistant line shall be determined by Community Management as if there were a Mobile Home on the vacant lot. Community Management may, at its sole discretion, further restrict land use (including moving lot lines or Community Residents built fences) as needed to provide for and protect communal areas, utility access, or for any other purpose.

8.     Binding of Rules

a.       These rules shall form a part of the Tenancy Agreement between a Tenant “Community Resident(s)”, and the Landlord, QualityLiving Management Corp. “Community Management”, with Landlord and Tenant having the meaning prescribed to them by the Mobile Home Sites Tenancies Act, Alberta, and are binding on the same.

9.     Additional Rules or Amendments to Rules

a.       Community Management may make changes or enact new rules from time to time, as it sees fit, in a manner consistent with the Mobile Home Sites Tenancies Act, Alberta.
